In this webinar, Ballard Spahr’s auto finance and leasing attorneys will explore the application of UDAAP principles to auto finance and auto leasing programs. UDAAP is the centerpiece of the Consumer Financial Protection Bureau’s activities in supervision and enforcement in many areas of consumer finance, and we expect it to be similarly prominent in examinations and enforcement actions in auto finance. Additionally, the Supplementary Information discussion of auto leasing that accompanied the proposed larger participant rule suggests that UDAAP also will figure prominently in auto leasing.

We will cover the following topics:

  • What is UDAAP, and how is it defined/identified by the CFPB?

  • Dealer conduct: to what extent might an assignee of retail installment sale contracts or vehicle lease agreements be held liable for alleged UDAAP violations by an auto dealer?

  • Interplay with state UDAAP laws: how is the CFPB’s application of UDAAP different?

  • Hot UDAAP areas for auto finance and leasing: our predictions

  • Detecting and mitigating UDAAP risk through an effective compliance management system
