Significant changes to Pennsylvania law governing retail installment sales will take effect before the end of this year as a result of Act No. 2013-98 (Act 98). Act 98 repealed the Pennsylvania Motor Vehicle Sales Finance Act (MVSFA) and Goods and Services Installment Sales Act (GSISA) and reenacted and consolidated the two statutes with amendments in Title 12 of the Pennsylvania Consolidated Statutes in a new Part V titled “Consumer Credit.”

These changes will affect motor vehicle dealers and other retail sellers of consumer goods and services that are located in Pennsylvania or make online sales to Pennsylvania residents, and offer financing under installment sale contracts. Act 98 also will affect sales finance companies and banks (regardless of where they are located) that purchase such installment sale contracts. The law will require revisions to documentation, practices, policies, and procedures used in closed-end credit sales of goods (including motor vehicles) and services made in Pennsylvania, regardless of where the sales finance company or bank is located.

The GSISA changes will also be of interest to retail sellers offering open-end credit, as well as credit card issuers issuing cards to Pennsylvania residents.
