Everyone is trying to get into the mobile payments space—technology companies, device manufacturers, software developers, retailers, and financial institutions. News reports of Apple entering the mobile payments space with its next iPhone underscore the importance of this market segment.

As companies continue to innovate in the mobile space, the law has fallen behind. There are no laws specific to mobile payments, and existing consumer financial services laws and regulations are not always easily adapted to the unique challenges associated with the mobile channel. At the same time, the Federal Trade Commission, the Consumer Financial Protection Bureau, and other federal regulators have begun to focus on whether consumers engaged in mobile payments are adequately protected.
