Colleges and universities continue to face scrutiny regarding the effectiveness of the institutional response to sexual violence. Institutions must navigate multiple federal, state, and internal requirements while ensuring safe campus communities; adjudicating claims equitably, including providing due process to the accused; interfacing with law enforcement; and communicating effectively with campus constituents. This two-part presentation will provide timely and practical guidance to colleges and universities seeking to comply with legal obligations in the prevention, investigation, and resolution of sexual harassment and misconduct allegations.
Part I will address:
- Lessons learned from recent OCR settlements, including best practices in developing coordinated policies, procedures, and practices and the roles of responsible persons
- Critical considerations in adjudicating sexual violence cases (including FERPA)
- Common pitfalls in Clery Act reporting and new requirements under the Campus SaVE Act
program
