In recent months there has been increased attention in the media to the fiscal difficulties of state and local governments, including speculation of widespread municipal bond defaults and municipal bankruptcies.

Representatives from Ballard Spahr's Public Finance, Litigation, and Bankruptcy, Reorganization and Capital Recovery practice groups will discuss these topics, with an emphasis on rights and remedies available to bondholders and trustees in connection with municipal insolvency and payment defaults. Additionally, we will discuss the exercise of creditor remedies through negotiations and litigation, the application of distressed municipality law, and the ability to use Chapter 9 of the Bankruptcy Code to address challenging fiscal issues now facing municipalities.
