The Employee Free Choice Act may not have passed Congress, but many of its goals are being pursued through the administrative process, affecting both union and merit shops. With the change in the White House and the makeup of the National Labor Relations Board, traditional labor law is being transformed, piece by piece. The new Board has reversed a number of Bush-era cases, and more reversals and pro-union initiatives will follow.

This program will cover these developments, including the much-publicized NLRB Facebook complaint, the NLRB General Counsel's emphasis on emergency injunctive relief in organizing cases, and the Board's renewed attention to union and employee rights.
