The NLRB general counsel's office recently released a series of Obama-era opinion memos on labor issues including dress codes, workplace video recordings, and strike replacements. The memos from Obama GC appointee, Richard Griffin, discuss these issues in cases involving Walmart, Boeing, and Star Fisheries.

Ballard Spahr Partner Steven Suflas commented that these memos are "historical anomalies" and are "based on since-overturned precedent or labor-friendly legal readings unlikely to be co-signed by current GC Peter Robb." However, Mr. Suflas added that "[e]ven if they are kind of artifacts from the prior administration… the board has now become so politicized that these theories could all be back."
