U.S. Department of Justice (DOJ) attorneys, citing the Class Action Fairness Act (CAFA), filed a statement of interest in a false advertising case against Wines 'Til Sold Out, a website that sold wine. Ballard Spahr Partner Burt Rublin said the "DOJ cherry-picked this case because it’s an obvious poster child for the kind of class action abuse that animated the enactment of CAFA way back when." The statement of interest regarding the fairness of the settlement came a day after Associate Attorney General Rachel Brand indicated that the DOJ would get more involved in reviewing class action settlements.
