This program is designed to provide attorneys with an understanding of ethical duties arising in discovery, including obligations impacting investigations and litigation. Particular emphasis will be given to new amendments to federal discovery rules, including discussion of the rules in practice during the first seven months after their effective date, emerging issues for litigants, and the intersection of these issues with the ethical rules governing the practice of law. 

Topics will include:

  • Pre-litigation document management and preservation best practices and how they intersect with professional conduct rules
  • How to navigate the discovery process and ethical obligations in litigation
  • Protecting privilege and confidential client information
  • Limits to preservation obligations
  • Discovery failures and consequences
