A pending lawsuit has led to a five-month delay of the new federal rule that requires employers to display a poster in the workplace that outlines workers’ rights to organize under the National Labor Relations Act.

In a December 23 announcement, the National Labor Relations Board (NLRB) said it agreed to postpone the effective date of its rule from November 14, 2011, to April 30, 2012. The NLRB’s decision was apparently at the request of a federal court presiding over lawsuits brought by manufacturing groups and employers challenging the legality of the new notice-posting rule.

In an August 29 alert, we outlined the details of the rule. In a September 20 alert, we discussed the court challenge to the rule brought by the National Association of Manufacturers in the United States District Court for the District of Columbia.

According to a statement on the NLRB’s Web site, the NLRB determined that “postponing the effective date of the rule would facilitate the resolution of the legal challenges that have been filed with respect to the rule.”
