Vincent J. Marriott III is a partner in the Litigation Department and Practice Leader of the Bankruptcy, Reorganization and Capital Recovery Group. He is also a member of the CCRC Financing and Workout, Health Care, and Commercial Real Estate Recovery Groups. Mr. Marriott is experienced representing corporate and other types of commercial businesses, financial institutions and trade creditors, and acquirers of distressed assets in the areas of corporate finance, workouts and reorganizations, recapitalizations, and asset purchases and sales, both inside and outside of insolvency proceedings.

Mr. Marriott also has a general commercial litigation practice. He has extensive experience representing trade creditors and creditors' committees in Chapter 11 bankruptcy proceedings, including most recently as committee counsel to the Official Committee of Unsecured Creditors in the Chapter 11 proceeding of National Century Financial Enterprises, Inc. He is also experienced in prosecuting and defending preference actions.

Representative Matters

  • Representation of a Chapter 11 trustee in the successful liquidation of a real estate holding company, resolution of fraudulent transfer and other litigation, and confirmation of a liquidating plan 
  • Representation of an indenture trustee as a member of the creditors' committee in a major chemical company bankruptcy 
  • Representation of the stalking horse bidder in the acquisition of a distressed continuing-care retirement community 
  • Representation of the acquirer of the low-income housing tax credit portfolio out of the bankruptcy of a major financial services company 
  • Representation of a major client in the wind-down of a complex joint venture with a bankrupt chemical company 
  • Representation of a client asserting a claim against the acquirer of assets from a bankrupt entity 
  • Representation of the creditors' committee in the bankruptcy of one of the largest financers of health care receivables
