Lynn R. Axelroth is a partner in the Real Estate Department. She is a member of the Construction, Health Care, Eminent Domain, Energy and Project Finance, Housing, P3/Infrastructure, Real Estate Development, Real Estate Finance, Resort and Hotel, Transactional Finance, Zoning and Land Use, and Higher Education Groups, as well as the Distressed Real Estate Initiative. Her practice includes representing corporate, institutional, individual, and public owners; public/private joint venturers; lenders; prime and trade contractors; and design professionals in all aspects of real estate development, construction and design contracts, financing, and alternative dispute resolution. She was the first managing partner of the firm's Philadelphia office and formerly chaired the Construction Group.

Among other representations, Ms. Axelroth has represented a world-class orchestra in connection with the design and construction of its new concert hall; a Major League Baseball team in the development of a new ballpark and a spring training and Minor League facility; the nonprofit developer of the largest regional visitors center in the United States; a transportation authority in the acquisition and turnkey development of its headquarters facility; health care institutions in the development of medical office building condominiums, hospitals, and surgicenters; universities in the development of research, classroom, dining, and dormitory facilities; developers of high-rise office towers, hotels, and apartments; private entities in public/private developments of mixed-use commercial, retail, and entertainment projects; lenders in the workout of multilender loan transactions; and the owner of a daily newspaper starting its first publication in North America.

Representative Matters

  • Represents the Allston Development Group of Harvard University in all aspects of construction and design contracting for the Allston Initiative, a multiyear, multibillion-dollar expansion of Harvard's campus
  • Represented an urban university in the acquisition of and redevelopment for numerous academic uses a multimillion-square-foot post office facility
  • Represented a university and health care system in the development of offices, structured parking, and outpatient hospital facilities
  • Represented a multihospital health care system in the resolution of disputes in its billion-dollar capital improvements project, and developed form design, construction, and procurement agreements
  • Assisted Comcast in connection with Americans with Disabilities Act issues in the design of its 800,000-square-foot world headquarters office tower in Philadelphia
  • Represents the Independence Visitor Center Corporation, a nonprofit developer, in the redevelopment of Independence Mall in Philadelphia, in partnership with the National Park Service, including design and construction contracts for the Independence Visitor Center (which serves Independence National Historical Park, the City of Philadelphia, and the eight-county Philadelphia region), new Liberty Bell Center, Visitor Center Café, and new visitor center in City Hall
  • Represents a Fortune 50 company in licensing issues arising from the acquisition of a multistate engineering firm
  • Represented a world-class orchestra in connection with the design and construction of its new concert hall, including drafting and negotiating the agreements with its construction manager and design professionals and the operating agreements with a regional performing arts center
  • Represented a developer in negotiating design agreements with world-renowned architects for two new restaurants in New York City
  • Represented a Major League Baseball team in the development of a new ballpark, spring training and Minor League facility, including bidding issues and negotiating and drafting design and construction agreements
  • Represented a transportation authority in the acquisition and turnkey development of its headquarters facility
  • Represented health care institutions in the development of medical office building condominiums and surgicenters
  • Represented pharmaceutical companies in the design and construction of headquarters buildings, research and development facilities, and pilot plants
  • Represented owners of high-rise office towers and mixed-use developments in connection with design and construction contracts
