The Dodd-Frank Wall Street Reform and Consumer Protection Act promises to transform the nation's consumer protection regime through its creation of a new federal regulator: the Consumer Financial Protection Bureau. The Bureau will have unprecedented authority to adopt and enforce substantive regulations that apply to virtually anyone who is a provider of consumer financial products or services. For many financial institutions and their related companies, the new legislation will result in the weakening or total elimination of their ability to rely on federal preemption to reduce their compliance burdens.
