Different government agencies purport to offer incentives for self-disclosure of alleged wrongdoing, but the procedures for self-disclosure are not uniform, the benefits are not always clear, and the risks are not always apparent.
This panel will address the self-disclosure regimes of various federal agencies and several "hot" areas of government law enforcement: DOJ/Foreign Corrupt Practices Act (FCPA), SEC/securities fraud, DOJ/antitrust, HHS/healthcare, and others. Issues for discussion will include differences between disclosure regimes, individual versus corporate clients, how to weigh the pros and cons of disclosure, formal versus informal disclosures, and the format of disclosure.
