With the change in the White House and the makeup of the National Labor Relations Board, traditional labor law is being transformed, piece by piece. The new Board has reversed a number of Bush-era cases, and more reversals and pro-union initiatives will follow.

Defining ‘Disability’: New Regulations Implement ADAAA
The U.S. Equal Employment Opportunity Commission on March 24, 2011, announced release of its final regulations implementing the ADA Amendments Act. The ADAAA, which went into effect on January 1, 2009, overturned a series of U.S. Supreme Court rulings that purported to narrow the scope of protections afforded by the Americans with Disabilities Act.

Whistleblowing in the Workplace
Doors have opened for whistleblowers. The Dodd-Frank Wall Street Reform and Consumer Protection Act introduced new incentives for reporting violations of securities and commodities laws—making whistleblowers eligible for bounties of 10 to 30 percent of recoveries exceeding $1 million and granting increased protection from retaliation. Similarly, the federal False Claims Act has been amended to protect from retaliation a far broader class of individuals than had been protected under the FCA.
