Somebody's Watching Me: The Legal and Practical Issues of Employee Monitoring

Companies are increasingly keeping a close eye on employees' activities. The monitoring of video, computer, and phone use and GPS tracking are commonplace in many organizations. This program will discuss workplace issues associated with monitoring employees, including policy development, the duty to bargain over monitoring, wiretapping statutes, discipline of employees based on surveillance, and constitutional concerns.

I Won't Be in Today: The Interplay of Employee Rights under the ADA and FMLA

In 2009, Congress and the DOL expanded the FMLA, including overhauling regulations and introducing new military family leave benefits. In addition, Congress expanded the rights of disabled workers through the ADA Amendments Act, for which the EEOC has issued proposed regulations. Because the FMLA and the ADA present complex compliance issues for employers, we will explore such issues in light of the recent changes. Topics will include disability vs. serious health condition; eligibility; the role of essential job functions and job descriptions; and leave and other forms of reasonable accommodation, including those involving undue hardship and direct threat.

Religion in the Workplace: The Struggle to Accommodate Varying Beliefs

Today, more and more businesses are operating globally and the face of America's work force grows increasingly diverse. Businesses must hone their sensitivity to religious beliefs and know how to legally accommodate various beliefs in the workplace. This webinar will look at maintaining a collaborative, productive, nondiscriminatory workplace while implementing religious accommodations and easing any tensions based on religious differences. The trend of incorporating religious affinity groups into diversity programs will also be discussed.
