During its first four months, the Obama administration already has signaled a much greater interest than the prior administration in enforcing, as well as shaping, antitrust law. Companies need to be prepared for more vigorous enforcement of the antitrust laws. Companies also need to be aware of potential changes in antitrust law that may be ushered in by the new administration. With the potential liability and punishment for violating antitrust law, careful planning and monitoring of areas of sensitive conduct are key.
Our panel will discuss some of these changes and what they may mean for companies. We will begin our presentation with a short primer in antitrust law. We will then focus on three topics likely to be priorities as a part of the “new mood in antitrust” under the new administration: monopolization, collaboration among competitors, and intellectual property. We will conclude by offering some practical tips for avoiding antitrust pitfalls in an age of increased scrutiny.
