Student Loans

For more than 20 years, our attorneys have worked with state agency and nonprofit student loan issuers in structuring and funding federally guaranteed and private student loan programs. We serve as bond counsel and underwriter's counsel in these financings, participating since 2004 in 46 issues aggregating $9.2 billion.

Our experience, which encompasses both tax-exempt and taxable student loan financings, includes representing since 1988 a state student loan program in the issuance of over $2 billion of tax-exempt and taxable debt, serving as corporate counsel for a nonprofit student loan issuer, and acting as underwriter's counsel for student loan financings from coast to coast.

In this difficult economic climate, we have restructured transactions, worked on tenders for outstanding bonds, and counseled on options for reducing exposure to failed auctions and downgrades on insurers and other credit enhancers. We also help clients use the federal programs for providing financing and liquidity.

Our affiliate, Avant Strategic Partners, has developed a niche practice in providing comprehensive arbitrage financial analysis and consultation, specifically with respect to student loans. Working with our tax partners, Avant colleagues have been instrumental in obtaining favorable tax positions and conclusion of controversies for student loan bond issuers.
