Our Insurance Group boasts industry veterans who handle the full scope of business, regulatory, and litigation matters for domestic and international carriers, brokers, and other insurance-related businesses.
Our attorneys represent insurance carriers and brokers, defend insureds at the carriers' request, assist carriers in claims investigations, and issue opinion letters on the scope of coverage. In all cases, our clients benefit from our resources as a national firm as well as our attorneys' local and regional market knowledge.
We also represent insurance clients in matters that go beyond insurance law, including bankruptcy, tax, health care, construction, and governmental investigations.
Our attorneys analyze coverage issues arising from all types of policies, including commercial general liability, professional liability, directors and officers liability, automobile liability, garage liability, environmental liability, and employment liability policies.
Bad Faith Defense
Our experience covers all lines of insurance and the full range of issues typically seen in bad faith litigation, from excess judgments to handling UM/UIM claims. We are often called upon in complex bad faith matters, including where legal malpractice of panel counsel is alleged.
Insurance Class Action
We defend a variety of insurers in class actions, including those involving RICO claims. Our attorneys frequently represent HMOs in both statewide and nationwide actions, are active in car insurance matters, and handle cases involving UM/UIM coverage and claims. We also defend title insurance underwriters against claims involving agent performance.
Fidelity and Surety Bond
We regularly handle claims of self-dealing, gross negligence, misappropriation, and the like, with millions of dollars at stake. We represent sureties in complex underwriting matters, numerous substantial claims and suits, related bankruptcies, and recovery efforts arising from alleged defaults under financial guarantee bonds and all types of performance bonds.
We defend insurance brokers against claims of malpractice involving the procurement and retention of coverage and other aspects of the brokerage process. We represent both wholesale and retail brokers in high-exposure matters involving various lines of coverage, in both state and federal litigation.
We negotiate, draft, and analyze reinsurance agreements and reinsurance commutation agreements, and petition for their approval. We also draft and analyze documents relating to the formation and management of offshore captives.
Our attorneys have been involved in significant, high-profile matters arising in rehabilitations and liquidations of insurance carriers. In large liquidations, we negotiate, draft, and petition for approval of agreements of commutation, novation, substitution, and settlement. We are experienced in defending against accounting-malpractice claims, representing and defending directors of insurers in D&O claims leveled by liquidators, and representing state guaranty funds.
We regularly conduct reviews of internal controls, representing the company, the board of directors, the audit committee, or a special independent committee. Our attorneys represent clients in SEC investigations and conduct internal examinations.
Directors and Officers/Professional Liability Insurance
We defend officers and directors on behalf of carriers and defend alleged claims of malpractice by lawyers, trustees, accountants, insurance brokers, and other non-medical professionals. At the request of a carrier, we also prosecute actions involving malpractice by professionals whose conduct has caused a covered loss to an insured.
