John P. McLaughlin is a partner in the Litigation Department and a member of the Labor, Employment and Immigration Group and P3/Infrastructure Group. Mr. McLaughlin counsels clients in employment litigation involving wrongful discharge, whistleblower, and employment tort and contract claims, and in labor litigation involving claims under the Fair Labor Standards Act (FLSA), Labor Management Relations Act (LMRA), and Employment Retirement Income Security Act (ERISA). He also advises on compliance with federal and state Equal Employment Opportunity (EEO) and other employment laws. He focuses additionally on workplace counseling relating to hiring and firing practices, and sexual and other types of harassment investigations.
A significant portion of Mr. McLaughlin's practice is dedicated to labor arbitration, collective bargaining in both the private and public sectors, and employment defense litigation involving claims of discrimination, harassment, and retaliation under Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), and the Family and Medical Leave Act (FMLA). He represents clients in NLRB and PLRB litigation, Heart and Lung Act litigation, police and fire disability and pension issues, and other litigation involving public sector employees.
Most recently, Mr. McLaughlin successfully represented the Pennsylvania Turnpike Commission in its constitutional challenge to the amendment to Act 195 that attempted to authorize collective bargaining and interest arbitration for the commission's first-level supervisors. He also successfully represented the Philadelphia School District in its $37 million arbitration involving pay practices in 2006 and 2007.
