Katrina M. Quicker is a partner in the Intellectual Property Department and a member of the Patents, Intellectual Property Litigation, and Higher Education Groups. Her practice focuses on IP litigation in federal courts and before the U.S. International Trade Commission, with an emphasis on life sciences technology.

Ms. Quicker serves as a Special Assistant Attorney General for the State of Georgia for intellectual property matters.

Concentrating on patent and trademark issues, Ms. Quicker has a particular focus on pharmaceutical, biotechnical, chemical, and mechanical patent litigation in trade remedy actions brought under Section 337 of the Tariff Act of 1930. She also has experience drafting and prosecuting pharmaceutical, biotechnical, chemical, and mechanical patent applications; counseling clients on intellectual property issues, including licensing; prosecuting trademark and copyright applications; and litigating trademark, trade dress, copyright, and trade secret issues.

Representative Matters

  • Cambridge University Press v. Becker (N.D. Ga.). Represented the Board of Regents for the University System of Georgia against publishers in copyright infringement case over Georgia State University's use of electronic course content, including its electronic reserves system. The case involved complex issues of fair use and sovereign immunity.

  • Advised UCB Pharma Limited, a subsidiary of Belgium pharmaceutical company UCB S.A., on the €55 million sale by UCB Pharma Limited of the worldwide rights outside the United States, Canada, and Barbados to Equasym IR and XL (methylphenidate HCl), for the treatment of attention deficit hyperactivity disorder (ADHD) to Shire Pharmaceuticals Ireland Limited, a subsidiary of Shire Pharmaceuticals Group.

  • In re Certain Nitrile Gloves (I.T.C.). Represented Tillotson Corporation against more than 50 foreign manufacturers and domestic importers in one of the largest patent infringement investigations to date in seeking an order that would bar the importation and sale within the United States of nitrile gloves (class I medical devices) that infringe Tillotson's patent.

  • Tillotson Litigations (N.D. Ga. and D. Del.). Represented Tillotson Corporation d/b/a Best Manufacturing Co. in protecting its patented nitrile gloves in 14 patent infringement cases against both domestic and foreign defendants.

  • Banner Pharmacaps Inc. v. Ranbaxy Labs. Ltd., et al. (M.D.N.C.). Represented Banner in a suit for patent infringement based on Ranbaxy’s filing of a 505(b)(2) application for softgel ibuprofen with the FDA.

  • Banner Pharmacaps Inc. v. Perrigo Co., et al. (M.D.N.C.). Represented Banner in a suit protecting its film-enrobed unitary-core tablet patented technology and secured a summary judgment finding of infringement against Perrigo.

  • Cardinal Health 409, Inc. v. Banner Pharmacaps, Inc. (M.D.N.C.). Persuaded Cardinal to dismiss its patent infringement complaint against Banner before Banner filed an answer.

  • Donald J. Davidson and Abbott Labs. v. Drs. Cao, Folkman, O’Reilly, The Children's Medical Center Corp., and Entremed, Inc. (D. Mass). Successfully represented Entremed in its suit with Dr. Davidson and Abbott by litigating and negotiating a patent license directed to the antiangiogenic activity of the kringle 5 region of a plasminogen molecule and its use in cancer treatments.

  • Celgene Corp. v. James E. Rogan and Entremed, Inc. (D.D.C.) and Entremed Inc. v. Celgene Corp. (D. Md.). Resolved Entremed’s patent infringement and antitrust suits with Celgene concerning patents directed to a thalidomide analog for use in cancer therapy.
