Arash Micaily is an associate in the Litigation Department and a member of the Environment and Natural Resources Group, Energy and Project Finance Group, and Climate Change and Sustainability Initiative. His practice consists of assisting clients in various aspects of transactional work, regulatory counseling, compliance matters, and environmental litigation.

Mr. Micaily has experience in handling environmental aspects of real estate and business transactions through the representation of lenders, developers, and businesses in compliance and transactional issues relating to risks arising from property contamination, wetlands, endangered species, underground storage tanks, and historic resources. Consequently, part of his practice involves helping clients manage and deal with difficult and complex environmental permitting and land use issues and determining appropriate siting for future business projects.

Mr. Micaily is also experienced in regulatory counseling related to the Clean Air Act. His work with the Clean Air Act is focused on both analyzing and commenting on recent changes to National Ambient Air Quality Standards and counseling on permit compliance with issues related to these changes. He has also represented clients in superfund litigation, wind energy facilities nuisance actions, the Pennsylvania Sewage Facilities Act, and claims brought under the National Environmental Policy Act. Earlier in his career, Mr. Micaily assisted clients in mergers and acquisitions, securities compliance, and bond transactions.

In December 2010, Mr. Micaily co-authored an article published in the American Bar Association's Environmental Transactions and Brownfields Committee Report – Environmental Energy and Resources Law: The Year in Review 2010 on the recent developments in Environmental Due Diligence and Phase I Environmental Assessment Liability for Consultants. In addition, he co-authored the legal section of Assessment of Risk, Legal Issues, and Insurance for Geologic Carbon Sequestration in Pennsylvania, a report to the Pennsylvania General Assembly prepared by Tetra Tech, Ballard Spahr, and others for the Pennsylvania Department of Conservation and Natural Resources.

Pro Bono Experience

Mr. Micaily has represented NOLArize! in its attempt to become recognized as a nonprofit 501(c)(3) organization. In addition, he drafted the privacy policy for the Pennsylvania Humanities Council and has served as a voter protection volunteer on a partisan and nonpartisan basis for several election periods, including the 2008 presidential election.
